As Sharon McShurley prepares to assume the Mayor’s office as of January 1st, we have contacted the Secretary of State’s office for clarifications, in light of the possibility of a further appeal by now-unsuccessful Democratic candidate Jim Mansfield. The secretary of state has confirmed that the person certified by the December 20th deadline will assume the mayor’s office as of January 1st. McShurley will have full power as mayor as of that date. The December 20th date is set by state statute. However, a judge may, with good cause, extend a recount or other action until any reasonable date at his/her discretion. At one point, the December 20th date had NO exceptions. However, in May of 2003 the East Chicago mayoral primary was overturned. The Legislature amended the statute in 2005 to allow extensions for “good cause” shown by a court.
