A racial harassment lawsuit against Ball State has gone to the U-S Supreme Court. The high court is using the lawsuit by a Ball State catering assistant to clarify a pair of 1998 rulings on workplace harassment. Those rulings concluded an employer is automatically liable for harassment by a supervisor if the harasser is just a co-worker, while the employer is only in trouble in case of negligence. Lower courts have disagreed on how much authority you have to have to be considered a supervisor.
